Preamble

The general conditions of sale should be read carefully. They constitute the elements of the contract for the provision of services offered by AnC Déco . The order will only be taken into account when you have accepted these general conditions of sale. Any Customer of AnC Déco acknowledges having read this document before having signed an estimate with the mention "good for agreement" or an invoice, and having the capacity to contract with AnC Déco . Any signing of an AnC Déco estimate or invoice implies express and unreserved acceptance of these conditions.

 

Any national of the European Community and of countries complying with Directive 95/46/EC cannot assert his lack of linguistic knowledge as a cancellation clause for the contract. These general conditions of sale may be modified at any time by AnC Déco .

Article 1: Website and contractual commitment

The main purpose of the AnC Déco website is to provide information on the services offered by the AnC Déco company.

We only take into account firm orders, after signature of an estimate with the mention “good for agreement”. You will show your commitment and your acceptance of these conditions of sale by signing the quote made by us. From this moment, the order will be firmly taken into account, which will definitively commit both parties. You will be committed to paying the amount indicated on the estimate. In return, AnC Déco will be committed to carrying out all the services indicated on this same estimate.

Article 2: Services

AnC Deco agrees to the following:

  • perform the services as defined in the estimate with diligence, in accordance with the rules of the art;

  • implement technical means adapted to the type of mission;

  • notify the Customer in the event of the detection of a problem affecting the proper performance of the services;

It is understood that, given the nature of the consulting services provided by AnC Déco , the performance of the various services corresponds to an obligation of means, in particular and without this being exhaustive, as to the number of man-days to be invested by AnC Deco .

AnC Déco undertakes to make every effort to bring satisfaction to its Customer, in accordance with the estimate established, by regularly informing him of the progress of its achievements. Once the file has been delivered to the Customer, the latter may not oppose AnC Déco with subjective arguments (of taste) to justify the restarting of these deliverables or the refusal of payment for the services for which he has committed. However, exceptionally and at the discretion of AnC Déco , adjustments may be made to these documents, at the Customer's request.

AnC Déco is prohibited from carrying out work that does not fall within its decoration consultancy activity (in particular drilling of walls, installation of lighting or materials, architect's mission). In this case, AnC Déco , at the Customer's request, may recommend two or three external service providers, the final choice always resting with the Customer. The intervention of AnC Déco consists in putting a Client in contact with qualified service providers in the decoration and building sector.

Article 3: Liability

When a Customer is put in contact with an external service provider, the Customer retains the free choice of the company to which he wishes to entrust his work and AnC Déco does not interfere in any way whatsoever in the contractual relationship, it being specified that the third party company does not act as a subcontractor of AnC Déco .

Thus, the estimate for the work will be issued directly by the third party company and no payment will pass through AnC Déco.

Therefore, when AnC Déco intervenes in the coordination of decoration projects, any contractual breach, delay, faulty workmanship or hidden defect attributable to a third party cannot in any case be blamed on it and incur its liability.

AnC Déco can be mandated by its Client, as a project management assistant, to assist it in monitoring the decoration projects with the various service providers. Under no circumstances does AnC Déco act as an architect.

It is the Client's responsibility to check with the external service providers on the technical feasibility of the planned operation (laying of materials, demolition of walls or partitions).

All the legal or contractual guarantees offered to the Customer in the context of carrying out the work are directly offered by the service providers concerned (ten-year guarantee, etc.).

In the event of a dispute, the Customer may only turn to the offending service provider. AnC Déco recommends that its Customers take out property damage insurance (DO) before starting a construction site, in accordance with the law of January 4, 1978.

As a result of the foregoing, AnC Déco cannot be held liable in the event of total or partial non-performance of the contract concluded by the Customer with the external service provider.

AnC Deco incurs no liability:

  • as for the information, documents and photos, transmitted by the Customer, the content of which remains under his full responsibility. AnC Déco relies exclusively on information provided by the Customer to perform the services ordered and therefore cannot be held responsible for incorrect information provided.

  • as to the realization and implementation by the Customer, of the decoration and layout recommendations provided by AnC Déco ,

  • for all damages of any kind whatsoever, which could result from the execution of the decoration and layout proposals recommended by AnC Déco and carried out directly or indirectly by the Customer.

When AnC Déco provides plans to the Customer, these plans are not intended to be directly intended for the realization or execution of the work. They are therefore transmitted for information only. The Client must ensure that the external service provider takes over the plan and validates the final dimensions before carrying out the work.

All the written and graphic documents transmitted by A nC Déco can in no way replace the technical execution plans (the layout of various networks, plumbing, electricity, various fluids, etc.) or any other form of design necessary for the carrying out the work prior to the interior decoration work.

As a result of the foregoing, AnC Déco cannot be held liable in the event that the external service provider has relied exclusively on the plans drawn up by AnC Déco without having taken the precaution of reviewing the dimensions and carrying out its own planes.

In addition, AnC Deco does not guarantee in any way that the colors on the screen or printed correspond exactly to the products on sale. Thus, the Customer is required to carry out the necessary verifications concerning the color by physically going to the store and/or by buying samples. As a result of the foregoing, AnC Déco cannot be held liable in the event that the color selected does not correspond exactly to the result after printing or screen display.

Under no circumstances will AnC Déco be held liable for any direct or indirect damage whatever the cause, origin, nature and consequences resulting from the use of the site or other sites linked to it. , in particular for any financial or commercial damage, loss of program or data suffered by the Customer who declares to have been aware and to have been informed of the possibility of such damage.

The Parties expressly agree that in the event of questioning the liability of AnC Déco , whatever the nature or basis of the action:

  • only direct damage is likely to give rise to compensation. Consequently, all indirect damages, and in particular commercial prejudice, loss of customers, any commercial disturbance whatsoever, loss of brand image, suffered by the Customer, its users, its own customers and/or by a third party, cannot give rise to to repair for the benefit of the Customer;

  • the amount of the repair likely to be charged to AnC Déco is expressly limited to the sums received by AnC Déco under the said service contract.

Article 4: Illustrations

We make our best efforts to illustrate our proposals in order to give you a realistic overview of the services offered. We would like to point out, however, that the photos, images and graphic representations appearing on our site www.anc-deco.com  or on our commercial documents are simply illustrative of our services and are therefore not contractual.

Article 5: Duration of the offer

The service offers offered on the AnC Déco website governed by these conditions of sale are valid as long as they remain online.

Our quotes are valid for two months from their receipt by the Customer.

Our gift vouchers are valid for 1 year from the date of their delivery.

Article 6: Rates

The prices charged by AnC Déco , offered on our quotes, are those in effect on the day of the order. All our prices are indicated in euros excluding VAT. Taxes are not applicable according to article 293B of the CGI.

The prices indicated on the site www.anc-deco.com and on our commercial documents are “From”. These prices are not contractual and are subject to change without notice.

Travel in Paris and the Paris region are included in the quote. Beyond that, travel and possibly accommodation costs will be invoiced in addition, it being specified that the supporting documents may be provided at the Customer's request.

Article 7: Order

On the day of the signature of the estimate by the Customer in two copies, this will serve as an order. Each of the two parties will keep an authentic copy of its commitments. As a general rule, a deposit of 40% will be requested before any execution of the project. The balance of 60% will be claimed upon receipt of the project.

In the case of services ordered remotely, the sale will only be concluded upon confirmation of the order, receipt of payment by check or validation of payment by the banking institution concerned, subject to validation by AnC Déco , elements provided by the Customer, namely: quality of the photos of the plans and photos of the rooms to be decorated and duly completed questionnaire.

It is up to AnC Déco to validate the elements provided by the Customer and to request, if necessary, the additional information necessary for the performance of the service. In the event that the additional information is not provided by the Customer and in the event that it is impossible to perform the service requested, the sums paid by the Customer will be returned to him within a maximum period of one month from notification by AnC Déco of the impossibility of performing the service.

This validation is done by sending an e-mail summarizing the order mentioning the indicative deadline for performance of the service and the indication that no right of withdrawal can be exercised after this sending.

Within the framework of a service including a follow-up of the decoration achievements, at the end of each service of AnC Déco , a receipt slip must be signed in duplicate by both parties.

AnC Déco , reserves the right to suspend any order management and any delivery, in particular non-performance by the Customer of its obligations - in particular in the event of non-payment (see Article 9 of these conditions). AnC Déco also reserves the right to refuse to make a delivery and to honor an order from a consumer who has not fully or partially paid for a previous order or with whom a dispute is in progress.

Process of the “remote projects” order

The ordering process complies with law 2004-575 known as the law for confidence in the digital economy (LCEN). In particular, any Internet user wishing to validate his order must identify himself by completing the appropriate questionnaire provided by AnC Déco . This identification is done in strict compliance with the law “Informatique et Libertés” n° 7 8-17 of January 6, 1978, amended in 2004, as indicated in the “legal notices” section.

After having validated the content of his order, the Customer will confirm it definitively. To this end, he must make his payment by bank transfer or send a check made out to:

Article 8: Invoicing

An invoice will be automatically sent to the Customer upon confirmation of the order. This will be sent to the email address indicated by the Customer when ordering, unless otherwise specified by him.

For “remote E-book Deco and E-Home Staging projects” and “gift vouchers” orders, the invoice will be issued after receipt of payment.

Article 9: Payment

Payment for AnC Déco 's services is made according to the following terms (unless otherwise specified in the quote): 40% on order and 60% on receipt of the deliverable.

Payment for AnC Déco 's decor coordination services is made according to the following terms (unless otherwise specified in the quote): 40% on order, 60% upon receipt of the service.

The payment of the decoration shopping services “purchase of furniture and decorative accessories” must be paid in full, in one go, when the order is placed by AnC Déco.

As part of a service including follow-up of the decorative achievements, if the Customer wishes to express reservations, these must be specified on the receipt slip (see Article 7 of these conditions). Under no circumstances can these reservations block the payment of the 60% due upon receipt of the service.

Payment for remote orders must be paid in full, in one go.

When AnC Déco travels for a visit to the Customer, the amount of this service is due in full on the day of the trip to the Customer's home. No reservations may be issued for the payment of services in accordance with Article 2 of these conditions.

You can make payment by check, bank transfer or cash.

Any amount not paid on the due date will give rise to the payment, by the Customer, of late payment penalties set at three times the legal interest rate. Pursuant to Article L.441-6 of the Commercial Code, these penalties are payable automatically by AnC Déco upon simple request. In addition, any professional in a situation of late payment will automatically be liable to his creditor for a lump sum compensation for recovery costs in the amount of €40.

In addition, AnC Déco reserves the right to seize the competent court so that it pronounces the forced execution of the payment, under penalty for each day of delay.

Article 10: Delivery

When our services include the recommendation of equipment or the purchase of furniture delivered by third parties, any delays in the deadlines for these deliveries can in no way be attributed to AnC Déco and its responsibility cannot therefore be engaged in this respect. .

Concerning the follow-up of the decorative achievements, a schedule will be communicated to the Customer with a date of receipt of the achievements agreed in advance with the external service providers. Any delay by the external service provider can in no way engage the responsibility of AnC Déco .

 

AnC Déco gift vouchers are sent according to the Customer's request, either electronically or by post within five working days. AnC Déco disclaims all liability in the event of saturation or malfunctioning of the email account given by the Customer, as well as any delays that may occur and which would be the responsibility of La Poste or the carrier. Indeed, AnC Déco cannot be held responsible for delays in delivery due to errors or disruptions attributable to carriers (total or partial strikes in particular of the postal services and means of transport and/or communication).

Concerning the “E-Book Déco” and “E-Home staging” remote services, the order will be placed at the latest within twenty-one working days from the day following that on which AnC Déco receives the payment.

AnC Déco undertakes to make its best efforts to provide the services within the period specified above; this deadline is given as an indication and any overrun will not give rise to the allocation of damages.

Article 11: Right of withdrawal

From the date of the order (signature of the estimate), and in accordance with the legislation in force, you have a period of fourteen days to assert your right of withdrawal from AnC Déco . To do this, you must send us within this period (postmark as proof) a registered letter with acknowledgment of receipt, indicating your intention to withdraw, to the following address:

The refund of the amount paid for the order will be made at the latest within fourteen days of receipt of the letter. This provision only applies to consumers.

Article 12: Cancellation, returns and reimbursement

Apart from your right of withdrawal within fourteen days, any request for cancellation, postponement or modification of an order is subject to the express agreement of AnC Déco . Failing agreement on the cancellation, your order cannot be refunded, and the amounts indicated will be entirely due.

All products that AnC Déco provides you with a return and/or refund guarantee from the supplier unless otherwise stated. The terms of return and refund will be those provided by our suppliers and service providers.

Section 13: Insurance

AnC Déco has taken out civil liability insurance with Matmut, which covers in particular the pecuniary consequences that may be the responsibility of the insured due to bodily injury, material and immaterial damage caused to Customers, service providers or third parties as a result of faults, errors of fact or law, omissions or negligence committed during its activity as a service provider. This insurance policy can be provided on request.

The Customer must himself ensure that the service providers he has chosen for the execution of the work are insured within the framework of their professional activity.

Article 14: Protection of your personal data

In accordance with the Data Protection Act No. 7 8-17 of January 6, 1978 amended in 2004, it is recalled that the information requested from the Customer is necessary for the processing of his order and is intended for the internal use of AnC Déco. .

This personal data may nevertheless be communicated to any competent authority for the settlement of disputes between AnC Déco and one of its Customers.

The Customer has a right of access, modification, rectification and opposition concerning his personal data. He can make the request by email or by post:

Section 15: Confidentiality

AnC Déco undertakes to keep confidential the personal information communicated by the Customer on the site.

However, the Customer authorizes AnC Déco to use the sketches, photos or documents of the Customer projects to illustrate its site or any other communication medium and therefore authorizes their distribution and reproduction.

Article 16: Proof

The computerized registers, kept on the servers of AnC Déco as well as on the servers of its banking establishments will be considered as proof of communications, orders and payments, made between AnC Déco and its Customers.

Article 17: Intellectual property

The general structure, as well as all the documents, information, texts, graphics, images, photographs or any other content published on the AnC Déco website or on any other medium are protected by copyright. author and intellectual property for the whole world and are the property of AnC Déco or have been the subject of an authorization for publication and distribution Consequently, and in accordance with the French Intellectual Property Code, only the use for private use is authorized, subject to more restrictive legal or regulatory provisions.

Any total or partial reproduction of this site or one of its elements without the express and prior authorization of AnC Déco is prohibited. Any representation, alteration, modification or reproduction of this site, by any means whatsoever, would constitute an infringement, punishable by the competent French courts.

The Customer is prohibited from launching any service on his behalf or on behalf of another brand or product that may compete directly or indirectly with the activity of AnC Déco .

The user who wishes to place, for personal or commercial use, on his site a simple link referring directly to the home page of the AnC Déco site, must request authorization. It will not be an implicit affiliation agreement. On the other hand, any hypertext link to the AnC Déco site and using the technique of framing or in-line linking is strictly prohibited. Otherwise, the offender is liable to legal action.

Article 18: Entirety

In the event that one of the clauses of these conditions is null and void, in particular due to a change in legislation, regulations or by a court decision, this cannot in any way affect the validity and respect of the other clauses of the general conditions of sale.

Article 19: Duration and applicable law

These conditions apply for the entire duration of the online services offered by AnC Déco and are subject to French law. In the event of a dispute, the parties will favor amicable treatment. In the absence of an amicable settlement, the competent courts will be seized.
